TOWN HALL – NEW IN 2026

•    The Receiver provided updates about the distribution status during a virtual town hall on June 25, 2026.
•    A recording of that town hall can be viewed here.
•    This Town Hall will answer many of your questions about distributions.

CLAIMS UPDATE

• The claims process has concluded.  Your claim amounts are now final.
  • All deposits are fixed.
  • All withdrawals are fixed.
  • You cannot add transactions to the User Portal.
• The final claims report can be found here.  Please log onto your User Portal for your specific claim information.

PAYMENT UPDATES

• The initial distribution is complete! In early 2026, the Receiver and his team completed the initial distribution of 45% to Class 3 users and 55% to Class 3A users.  Over 28,000 users received over $98 million in distribution payments.  The final report on the initial distribution can be found here.
• Eligible users who did not receive their initial distribution.  Approximately 4,000 users who are eligible for payment of approximately $3.4 million in distributions, but who did not provide payment information or timely cash a check sent to them (if one could be sent), will remain eligible for payment at the time of any second distribution. 
• Second Distribution. The Receiver anticipates conducting a second distribution likely in 2027, following resolution of various outstanding tax matters.  The Receiver cannot state at this time the amount of any second distribution.  Users who did not receive their initial distribution will receive the total amount of the initial and second distribution.  Instructions on how to provide payment information will be sent once a Second Distribution is authorized by the Receiver.
• What to do now?   There is nothing for you to do now other than to (i) monitor your emails for any correspondence from Stretto and (ii) periodically check the Receiver’s website and your user portal for any new notices.  When a second distribution is announced, the Receiver will provide instructions and deadlines for updating any payment information and for providing payment information if you did not provide payment information in connection with the initial distribution.

PAYMENT AMOUNTS

• Class 3 users (deposits over $1,000): You received 45% of your deposits minus withdrawals in the initial distribution. You might get more money later.
• Class 3A users (deposits $1,000 or less): You received 55% of your deposits minus withdrawals. This is your only payment.

NON-USER CLAIMS

All Non-User Claim deadlines have now passed.

On January 6, 2025, the Receiver filed with the Court a Notice of Amended Non-User Claims Report [Dkt. 427].  All Non-User Claims have been paid.  

ABOUT THE RECEIVERSHIP

What is a Receiver?

David Castleman has been appointed by the U.S. District Court (Southern District of New York) as the Receiver for EminiFX, Inc. in the case CFTC v. Eddy Alexandre and EminiFX, Inc.

As Receiver, Mr. Castleman:

• Works independently, reporting only to the Court
• Is responsible for protecting EminiFX assets
• Works to return money to EminiFX customers fairly
